The fine print of the UK GAAR (general anti-abuse rule) which is aimed at tax planning, will be published 11.12.2012. So children if your daddy is a tax practitioner and doesn’t make it home for Christmas – blame the Government. Only joking of course. Well at least I hope that none of my readers are going to spend Christmas pouring over the draft rules when they could be shopping. And kids – Santa Clause does exist! Perhaps this year there will be even more reason to give thanks to George Osborne and rejoice? Because it occurs to me that a planning arrangement that is not required to be disclosed under DOTAS cannot technically be abusive. Therefore legally, the GAAR can only apply where an arrangement is technically DOTASABLE. I do not know the answer to this question yet and will only properly research the point after 11th December. Meanwhile I have floated the question on the various global estate and tax planning groups that I belong to on Linked-In. So watch this space. At the first launch I drew an unprecedented parallel between writing a book about inheritance tax planning and the survival skills demonstrated by Indiana Jones in the Hollywood blockbuster ‘Indian Jones and the Last Crusade’, which ended up in the throwing into the air of a weathered cotton fedora hat – nearly knocking out the lighting at Waterstones (who were very forgiving). Last year they held the launch in the crime, science fiction, and fantasy section of the bookshop (which a cynical reader might think was quite fitting for a book about tax planning), and this year (like Bond) we are back – at 12.30 pm on Friday 7th December. So be there or be square, and prepare for the unexpected! If any readers are in Leicester that day I very much hope that you will attend. BOOK LAUNCH

Peut-être que cette année il y aura encore plus de raisons de rendre grâce à George Osborne et se réjouir? Parce qu’il me semble qu’un arrangement de planification qui n’est pas tenu de divulguer en vertu DOTAS ne peuvent techniquement pas être abusive. Par conséquent juridiquement, la RGAÉ ne peut s’appliquer que lorsqu’un arrangement est techniquement DOTASABLE. Je ne sais pas la réponse à cette question pour le moment et ne bien la recherche du point après le 11 Décembre.
